Nevada's vote-by-mail primary stirs fraud concerns, as unclaimed ballots pile up

Red flags are being raised about the all-mail voting system being used in Nevada’s most populous county ahead of the state’s June 9 primary election amid reports that thousands of ballots are being sent to inactive voters -- fueling concerns about the possibility of voter fraud and ballot harvesting.

Thousands of ballots have been sent out by the Clark County Election Department to inactive voters – those who have not voted in recent elections, a roster that can include people who either have moved or are deceased – and the envelopes are piling up in post office trays, outside apartment complexes and on community bulletin boards in and around Las Vegas.

The excess ballots have drawn complaints from local residents, who worry that anyone could pick up a ballot off the street and cast a fraudulent vote, as well as from Republican Party officials in the state who see a nefarious motive behind the vote-by-mail system being employed by the Democrat-dominated Clark County Commission.

“What’s going to happen with these things, they’re not secured at all and there are thousands of them just sitting here,” Jenny Trobiani, a postal worker in Clark County who told Fox News that she has seen hundreds of ballots being mailed to inactive voters.

“This just seems fraudulent to me, something stinks here,” she added.

While the coronavirus pandemic has elevated the conversation surrounding mail-in ballots to the national stage, the debate over the issue has been batted back and forth between Democrats and Republicans in the Silver State for a while.

Most recently, the Democratic National Committee, the Democratic Congressional Campaign Committee and progressive political nonprofit Priorities USA dropped a request for immediate relief in a lawsuit against Clark County after officials agreed to implement multiple changes to voting in June that included sending out ballots to inactive voters and opening up two additional in-person voting sites. The lawsuit, however, to eliminate the signature verification process is still in the courts.

Texas Supreme Court halts expansion of mail-in voting during pandemic

The Texas Supreme Court on Friday halted the expansion of mail-in voting in the state during the coronavirus pandemic.

The court issued the stay after Texas Attorney General Ken Paxton (R) asked the Lone Star State's top court to take action in a letter earlier this week.

The state Supreme Court has set oral arguments in the case for Wednesday.

Democrats and voting rights advocates have pushed for mail-in voting to be expanded during the pandemic, while Paxton has repeatedly argued that large-scale mail-in voting will lead to rampant voter fraud and corruption.

"Among the State’s highest and most profound interests is protecting the integrity of its elections," Paxton wrote Wednesday. "To advance that interest, the Texas Legislature requires almost every voter to vote by personal appearance at a designated polling place, where trained poll workers confirm the voter’s identity before issuing him a ballot."

I am pleased that today the Texas Supreme Court confirmed that my office may continue to prosecute voter fraud and issue guidance on mail-in ballots while that appeal plays out."

The Texas Democratic Party’s general counsel, Chad Dunn, had celebrated the earlier ruling this week while calling "for a few state officers to stop trying to force people to expose themselves to COVID-19 in order to vote."

Donald Trump Threatens to Punish Michigan for Mailing Absentee Ballot Applications to Voters

President Donald Trump on Wednesday threatened to punish Michigan for mailing absentee ballot applications to all state voters ahead of the election.

“This was done illegally and without authorization by a rogue Secretary of State,” Trump wrote on Twitter. “I will ask to hold up funding to Michigan if they want to go down this Voter Fraud path!”

On Tuesday, Michigan’s Secretary of State Jocelyn Benson announced that the state would send ballot applications — not actual absentee ballots — to 7.7 million voters in the state.

“By mailing applications, we have ensured that no Michigander has to choose between their health and their right to vote,” Benson said in a statement. “Voting by mail is easy, convenient, safe, and secure, and every voter in Michigan has the right to do it.”

The plan will cost $4.5 million, which the secretary of state said would come from the CARES Act. The act passed by Congress provides funding for Election Security grants.

The president also criticized Nevada, after they created a vote by mail primary.

President Trump has vocally opposed efforts to vote by mail, warning of the potential for serious voter fraud.

“So the problem with the mail-in ballots: It’s subject to tremendous corruption,” Trump said last Tuesday. “Tremendous corruption, cheating. And so I’m against it.”

Prominent Democrats including former President Barack Obama and failed presidential candidate Hillary Clinton continue to push for vote by mail in November, arguing that it is essential for voter safety during the coronavirus pandemic.  Congressional Democrats continue pushing legislation to enact federal vote by mail requirements, but Republicans have successfully blocked them from becoming law.

Recent data has not shown a compelling public health justification for vote-by-mail.

Wisconsin is one of the only U.S. states that held its primary election with in-person voting after the coronavirus lockdown began. Only a few dozen people at maximum were confirmed to have contracted the virus after participating either as voters or poll workers, and none of those cases were fatal.

Out of the 413,000 participants, that equals an infection rate below two-hundredths of one percent. Just days later, South Korea held national elections which did not result in any new coronavirus cases.

Former Rep. Darrell Issa (R-CA) and Judicial Watch sued California Gov. Gavin Newsom on Thursday over his May 8 executive order allowing all voters in the state to vote by mail — whether they had formally requested to do so, or not.

Newsom’s order cites the threat of coronavirus: because “it is unknown to what degree COVID-19 will pose a threat to public health in November,” mail-in ballots must be sent to everyone — but in-person voting must also be provided.

Judicial Watch filed a lawsuit on behalf of Issa, who is running for Congress again in the 50th district (as opposed to his former district, the 49th, which has become more liberal). Three voters — one Democrat, one Republican and one independent — are also named plaintiffs in the suit, which was filed in federal court in Sacramento. The defendants include both Newsom and Secretary of State Alex Padilla, who is responsible for administering elections in the state.

The lawsuit lays out a simple case: the U.S. Constitution provides explicitly that the state legislatures control the manner of electing members of Congress, as well as members of the Electoral College (who elect the president).

17. Neither Defendant is a “Legislature” as required under the Elections Clause or Electors Clause.

Moreover, the lawsuit argues, California’s Voter’s Choice Act of 2016 provides that county governments control the decision about whether to participate in an all-mail system of voting. And while the governor has emergency powers to override statutes, the governor is required to end the state of emergency as soon as possible. There is a risk of legal challenges after the election, hurting voters and candidates — especially in congressional districts that include more than one county, where some votes might have been cast legally and others under the new, allegedly unlawful system.

In a statement, Judicial Watch president Tom Fitton said: “California law prohibits blindly mailing out ballots to every registered voter in the state. This scheme raises the risk of Election Day chaos as well as voter fraud.”

Judicial Watch won an important victory in 2018 when it reached a settlement with the state and with Los Angeles County to remove more than 1.5 million inactive voters from the tolls. It has also warned 11 other counties of similar problems.

The Justice Department on Thursday announced charges against a Philadelphia election official for “fraudulently” stuffing ballot boxes to help Democrat candidates in the 2014, 2015, and 2016 primary elections.

Domenick J. DeMuro, 73, of Philadelphia, PA, a former Judge of Elections for the 39th Ward, 36th Division in South Philadelphia, has been charged and has pled guilty to a two-count Information charging (1) conspiracy to deprive Philadelphia voters of their civil rights by fraudulently stuffing the ballot boxes for specific Democratic candidates in the 2014, 2015, and 2016 primary elections, and (2) a violation of the Travel Act, which forbids the use of any facility in interstate commerce (here, a cell phone) with the intent to promote certain illegal activity (here, bribery), US Attorney William M. McSwain announced on Thursday.

DeMuro admitted in his guilty plea that he was actually paid by an unnamed political consultant to illegally add votes for certain Democrat candidates.

DeMuro received between $300 to $5,000 per election from the political consultant under the guise of “consulting fees” in exchange for adding fraudulent votes on the voting machines — also known as “ringing up” votes.

“DeMuro fraudulently stuffed the ballot box by literally standing in a voting booth and voting over and over, as fast as he could, while he thought the coast was clear. This is utterly reprehensible conduct. The charges announced today do not erase what he did, but they do ensure that he is held to account for those actions,” said U.S. Attorney McSwain.

“This defendant abused his office by engaging in election fraud for profit,” said Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division. “Today’s conviction makes it clear that the Department of Justice will do all in its power to protect the integrity of elections and maintain public confidence in all levels of elected government.”

'How secure!': RNC chairwoman rips mail-in voting after South Carolina ballots turn up in Maryland

South Carolina election ballots somehow ended up in Maryland this week after mail-in voting for South Carolina’s June 9 primary gets underway.

“Maryland election officials found a bunch of ballots from South Carolina mixed in with their shipments to Baltimore,” Baltimore Sun reporter Emily Opilo tweeted. “They use the same vendor. I just talked to an elections official in SC, and he says they're ready to dump the company.”

South Carolina officials say this isn’t the first time they’ve had trouble with SeaChange, the Minnesota-based printer they use, which prints and mails ballots for 13 South Carolina counties, according to Fox News.

A South Carolina election official told the Post and Courier that some voters had issues receiving their absentee ballots when the Democratic presidential primary and a special election for sheriff were held 10 days apart earlier this year.

Due to coronavirus concerns, more mail-in ballots are expected to be cast this year than ever before, and Democrats across the country have been pushing for expanded mail-in voting wherever possible.

House Democrats included over $3 billion in funding for expanded mail-in voting in their most recent coronavirus relief package proposal. House Speaker Nancy Pelosi defended the move by calling in-person voting too dangerous at the moment.

“Standing in those lines, for that amount of time, going to places that are enclosed, is dangerous to your health,” she said, before adding the process is “more democratic.”

“It gives people more options. It removes obstacles and barriers to voting, which is what we want to do.”

Republicans maintain that reports of 28 million missing mail-in ballots over the last decade, a significant amount of confirmed voter fraud cases in the United States and this week’s situation with South Carolina’s ballots raise too many questions about the security of mail-in voting.

RNC Chairwoman Ronna McDaniel defended President Trump’s position that mail-in voting is susceptible to fraud by citing the South Carolina ballot mix-up.

“The media argues @realDonaldTrump has 'no evidence' of mail-in ballot problems,” McDaniel tweeted. “Oh really? Look what just happened in SC, where Dems sued to force a rushed transition to mail with no safeguards. Their ballots magically appeared in Baltimore. How secure!”

The state of Michigan last week announced it is mailing absentee ballot applications to all 7.7 million registered voters.

President Trump threatened to withhold funding to Michigan if they “want to go down this Voter Fraud path!”

Speaker Pelosi has also been trying to sneak in federal ballot harvesting laws into several of the Coronavirus stimulus bills.

The Democrats see an opportunity to steal the 2020 election with mail-in ballots and ballot harvesting after the left successfully used the fraudulent system to flip Orange County from red to blue in 2018.

ENGELBRECHT: Yes. One that comes to mind – maybe the most notorious of late – happened in 2008 when Al Franken was working to defeat the incumbent Norm Coleman for a Senate position in Minnesota. After months of recounts and new mail-in ballots being discovered each time – each time benefiting Al Franken – the margin finally spread to a point that Al Franken won. They called the election. He went on to become the final vote necessary for the Affordable Care Act to pass. Without him, the count would have been such that that bill would not have passed.

Then, once all of the dust settled, and there was a closer look given to those ballots that had come in, it was learned that almost 400 of them were cast by convicted felons who had voted illegally. But that wasn’t known in the flurry of the mail-ins, and it forever altered the direction of our country.

DW: Those 400 tipped the scales? (1:19)

ENGELBRECHT: Right. The margin was 312, and then they came back and found almost 400 that shouldn’t have counted.

[In a post-interview addition, Engelbrecht said: Another more recent example is out of North Carolina, where a GOP operative was indicted on criminal charges for running an illegal absentee ballot-gathering operation. And in any case, regarding the Franken example, numerous reports rightfully raised the question whether he truly would have won – not only because of the felons’ votes but also because of the legal jousting after Election Day.

DW: What are the benefits of mail-in voting, and would the cost-benefit analysis be positive given that it might prevent in-person forms of fraud? (1:34)

ENGELBRECHT: Well, I think that there are instances in which voting by mail is appropriate. Certainly if you’re elderly or infirm, and you cannot go to a polling place, you need to have a way to still have your voice heard. If you’re out of the county or out of the state, if you’re overseas, certainly the military.

ENGELBRECHT: Absolutely, and in fact we’ve gone so far as to start an initiative where we are suing states that are taking such extreme measures to force this new process, if you will.

To give you some examples, in Virginia, the governor there – which True the Vote is suing the governor of Virginia for this very reason – in order to enact mail-in voting across the state instantly, the governor declared everybody in Virginia to be disabled, which would then meet the standard for their purposes to usher in full mail-in. Along with that, he removed the security provisions of signature comparison, and removed some of the standards around postmarks.

Again, those are the threadbare ways to affirm the accuracy, the integrity of a ballot – and they are being taken away in Virginia.

In Nevada, another place where we’re suing, the secretary of state there, by administrative fiat, announced that the whole state was going to be mail-in, and same thing, she removed the signature provisions. Then you saw another lawsuit being filed by the Democratic Party in Clark County that was settled in a friendly mystery agreement that we still haven’t been able to lay eyes on. A bizarre situation.

But one of the outcomes, according to Marc Elias’ tweets anyway, was that Clark County had agreed to hire vote harvesters. Even though vote harvesting is illegal in the state of Nevada, Clark County is now putting them on their payroll.

Trump: Twitter is interfering in the 2020 presidential election

The allegations came after Twitter fact-checked one of Trump's tweets for the first time, labeling it as false.

US President Donald Trump said on Tuesday that Twitter is interfering in the 2020 presidential election. The social media platform flagged his tweet earlier with a blue exclamation mark, urging users to "get the facts about mail-in ballots."

Twitter confirmed this was the first time it had applied a fact-checking label to a tweet by the president, in an extension of its new "misleading information" policy introduced this month to combat misinformation about the coronavirus.

According to Trump's original tweet, "there is NO WAY (ZERO!) that Mail-In Ballots will be anything less than substantially fraudulent. Mail boxes will be robbed, ballots will be forged and even illegally printed out and fraudulently signed." The President went on to say that "This will be a Rigged Election."

A click on Twitter's blue bar under Trump's tweet directs the reader to a different page with a few articles about mail-in ballots. Under a section titled "What you need to know," there is a summary that reads: "Trump falsely claimed that mail-in ballots would lead to 'a Rigged Election.' However, fact-checkers say there is no evidence that mail-in ballots are linked to voter fraud."

“They are saying my statement on Mail-In Ballots, which will lead to massive corruption and fraud, is incorrect, based on fact-checking by Fake News CNN and the Amazon Washington Post,” Trump tweeted in response. “Twitter is completely stifling free speech, and I, as President, will not allow it to happen!” he added.

The Trump campaign released a statement as well. “We always knew that Silicon Valley would pull out all the stops to obstruct and interfere with President Trump getting his message through to voters,” said Brad Parscale, Trump 2020 campaign manager.

“Partnering with the biased fake news media ‘fact-checkers’ is only a smokescreen Twitter is using to try to lend their obvious political tactics some false credibility,” he added. “There are many reasons the Trump campaign pulled all our advertising from Twitter months ago, and their clear political bias is one of them."

Following up on the criticism, White House press secretary Kayleigh McEnany tweeted a thread with several links to different examples of issues with mail-in ballots from across the US.

”This is corruption. This is fraud,” she said when shown a list of names of people who voted, including her name, according to WNBC.

She said she has eight relatives and neighbors who are listed as voting who say they never received ballots.

 

City Councilman Luis Velez told WNBC there are more cases like Javier’s.

“Where is the democracy in this? Where is the fair process?” Velez said, demanding that the FBI and state Attorney General Gurbir Grewal take action.

“FBI and Attorney General – you went to school just because you want to be a law enforcer? Then enforce the law,” Velez said. “Lock them up. Show them that we have law here and that no one can be above the law.”

In addition to the allegations from Velez and Javier, postal workers reported finding bundled ballots, 800 of which were thrown out by the Passaic County Board of Elections, WNBC reported.
