CNN investigation: 103 Uber drivers accused of sexual assault or abuse   CNN

After an evening of cocktails in San Diego, a woman got into the back of an Uber for a ride home. She was so intoxicated she had to ask the driver to stop so she could vomit. She says she then passed out in the backseat. When she regained consciousness, the Uber driver was on top of her, raping her, a block from her home, according to the police report and two sources familiar with the investigation. She was able to escape and dial 911. Police later arrested the Uber driver, John David Sanchez, 54. When they searched his computer, they found videos of Sanchez raping women and abusing young teenagers, dating back at least five years. In November, Sanchez was sentenced to 80 years in prison for the rape of the Uber passenger and 33 other counts against him, including sexual assaults of at least nine other women and children. Sanchez drugged many of his victims. A CNN investigation has found that Sanchez is just one of at least 103 Uber drivers in the U.S. who have been accused of sexually assaulting or abusing their passengers in the past four years. The drivers were arrested, are wanted by police, or have been named in civil suits related to the incidents. At least 31 drivers have been convicted for crimes ranging from forcible touching and false imprisonment to rape, and dozens of criminal and civil cases are pending, CNN found.

Uber will no longer force victims of sexual assault into arbitration

Uber says it is taking steps to help reduce the culture of silence around sexual violence on its platform in the wake of a CNN investigation into sexual assaults and abuse by Uber drivers. The rideshare company said Tuesday it will no longer force into arbitration passengers who allege that they have been sexually assaulted or harassed by drivers -- something Uber says was previously required under its terms of service. Instead, Uber will allow victims of sexual violence, including riders, drivers and employees, to choose the venue in which they want to pursue redress of their sexual harassment or assault claims, whether that's arbitration, mediation or open court. The change comes two weeks after CNN reported the results of its investigation, which found at least 103 Uber drivers in the United States who have been accused of sexually assaulting or abusing their passengers in the past four years. The drivers were arrested, are wanted by police, or have been named in civil suits related to the incidents. It was the first time that numbers have been put to the issue.Previously, upon signing up for Uber's service, Uber says users agreed to resolve any claims on an individual basis through arbitration. The practice, which has been challenged in lawsuits, helped the company keep the issue quiet, according to critics.

Woman says she was raped twice trying to take a Lyft home: cops

New York Post

A woman in Brooklyn said she was raped by a man she mistook for her Lyft driver — and then sexually assaulted a second time by a different motorist, high-ranking police sources said. The 25-year-old victim told cops she was having drinks with friends at Sweet Science in Bushwick at 4 a.m. Sunday when she called a car to take her home. She drunkenly got into a vehicle, thinking it was her ride, and was raped by the driver, she said.“It’s kind of f–ked up that her friends would let her walk out in that condition and not watch her get in the car,” the source said.Cops confirmed she’d ordered a Lyft and received a message telling her she’d missed her ride.

What we know (and don't know) about Uber background checks

Accused terrorist Sayfullo Saipov made over 1,400 trips as an Uber driver registered in New Jersey. He passed an Uber background check...Saipov also passed Lyft's background check -- and made 180 trips using the service, the company said. (In November 2017) Saipov allegedly killed 8 people driving a rented pickup truck to mow down cyclists on a busy Manhattan bike path.Records show Saipov had received traffic citations in the past, but Uber and Lyft said they were not disqualifying based on its criteria or under local and state law in New Jersey.News of the attack is nevertheless again drawing attention to how the companies vet their drivers. Both companies still mostly shun the idea of fingerprinting drivers. However, they've made some exceptions like in New York City, where Uber and Lyft drivers are fingerprinted because they are subject to the same standards as taxi drivers.Although the criteria for background checks varies by state, Uber mostly conducts digital background checks via a startup called Checkr. Lyft contracts with Sterling Talent Solutions for screenings. Both background check companies did not comment.

Who's driving? Uber, Lyft drivers accused of violent crimes

Atlanta Journal-Constitution-May 11, 2018

He was supposed to drive a 16-year-old girl to her Gwinnett County home. But instead, the 58-year-old man sexually assaulted the teen, according to police, and dropped her off partially dressed at an apartment complex.Abdoulie Jagne had worked as an Uber driver for several weeks when he was arrested in December and charged with rape...A recent CNN investigation found at least 103 cases involving Uber drivers sexually assaulting or abusing customers across the country in the past four years. Drivers for Uber’s biggest competition, Lyft, were accused in 18 assaults according to the study, which found that most of the assaults happened near major cities. According to reports compiled by The Atlanta Journal-Constitution, eight assaults involving ride-share services have happened in metro Atlanta and Athens. But with so many different police jurisdictions throughout metro Atlanta — and the possibility that some crimes were never reported — that number could be higher...In Georgia, drivers for Uber and Lyft have been accused of several violent crimes, including a homicide and physical and sexual assaults. Sometimes, the crimes involve people posing as ride-share drivers, making it more difficult to find the suspect...Uber was founded in 2009 in San Francisco and quickly set off a ride-sharing frenzy that has since expanded to international cities. Some 15 million trips are completed each day, according to the Uber company website. From a smart phone, those needing a ride can find a driver with a few quick button pushes on an online application... The Taxicab, Limousine & Paratransit Association (TLPA) highlights the risk of Uber and Lyft through its awareness campaign titled “Who’s Driving You?” The TLPA maintains an ongoing list of incidents involving Uber and Lyft drivers and has tallied 49 deaths, 93 alleged assaults, 367 alleged sexual assaults and 16 kidnappings since 2014.

Uber's process for onboarding drivers is dangerously negligent. Neither Uber nor Lyft uses fingerprints or law enforcement to background-check their drivers.
