The Word You Are Looking For Is “Sedition”
There have been many crimes committed in the course of Obamagate. There is also one, overarching crime — sedition.
The Russian Hoax is the single greatest political scandal in U.S. history, bar none. It makes Watergate look like jaywalking. It begins with Hillary Clinton, both the whitewash of her crimes, and the DNC’s attempt to drop the mother of all October surprises to make her crimes pale by comparison. It includes political spying and misuse of the legal system to overthrow a duly elected government. People’s lives have been wrongly destroyed by it. FISA warrants were falsely issued because of it. The 2018 election was influenced by it. And for three years, the duly elected government of the United States was hamstrung by it.
People have a First Amendment right to lie. Adam Schiff has a right to go onto MSNBC every night for three years and make bald faced lies into the camera. That is not criminal. But there is a clear line where First Amendment rights end. Politicians and employees of the government do not have a right to use the power of government to spy on their political opponents. Nor do they have a right to wrongfully use the legal process of the U.S. to attack their opponents, all aimed at overthrowing the duly elected government of the United States. President Trump has taken to calling this Obamagate, and implying that these coordinated acts constitute one or more crimes.
At least one reporter asked the President’s spokesperson, Kayleigh McEnany, the other day to define the elements of the crimes involved. As you can see, she gave a decent answer, highlighting some of the individual crimes surrounding the political spying, FISA warrants, civil rights violations, perjury, and others.
There is a big picture crime here that she neglected to add. This coordinated and concerted effort to destroy the Trump administration and nullify the 2016 election through illegal and criminal means is nothing short of sedition.
If two or more persons in any. . . jurisdiction of the United States, conspire to overthrow . . . the Government of the United States, . . . they shall each be fined under this title or imprisoned not more than twenty years, or both.
I urge Ms. Mcenany to look up the crime and its history. I am sure Asst. Atty Durham is aware of it.
As CNN contributor Jonathan Hurley writes at The Hill, and as Kimberly Strassel writes at the Wall St. J., nothing will alter the media narrative that the Trump administration conspired with Russia and the Obama administration was lily-white in all of this. Hillary Clinton committed no crimes with her server, the Obama administration never spied on Team Trump, the FBI was justified in pursuing the Trump administration, it is fine to do an ambush interview and create a process crime to politically assassinate Michael Flynn, the FISA warrants against Carter Page were well taken, the Mueller investigation that started well after the FBI knew that there was no unlawful conspiracy with Russia — then continued on for two years — was justified. To challenge any of this or to hold anyone liable is to “politicize” government — or in the words of Ben Rhodes, a man probably up to his ears in all of this — “bullshit.” Our democratic experiment is in mortal danger because of it.
