Look into where ARCI has landed on controversial issues to hit horse racing in the last 20 years.
They have been around since 1934 and have evolved too slowly to match the changes which have taken place in the society-at-large. Especially as it pertains to horse welfare.

And can you see the Supreme Court defeating a law signed by both Trump and Biden? That takes the partisan angle out right away. HBPA is just trying to delay the inevitable.

The NHBPA has landed on the wrong side of every horse welfare and safety initiative that threatens the status quo because the status quo is how they butter their bread.
They cannot adapt so they obstruct.
It's very simple.

The Supreme Court should just repeat what I said... "So you morons want to waste our time fighting for the right to cheat? GTFOOH!"
If the law was purely a Democratic effort signed by Biden, yeah, MAYBE they have a shot given how the court is stacked. But that's not the way this one happened.

As you pointed out days and even weeks ago, HISA is a bi-partisan law. I'd be surprised if SCOTUS would even hear litigation on it. Broadly speaking, it's an animal welfare law and that, philosophically, is naturally a bi-partisan issue. Do what's right by the horses, first and foremost.

Sable rattling by both party individuals who do not directly lead that side of the issue and are not budgeted by HISA on either side

This HISA deal will be amended etc when the jock unions take it to the NLRB.
Succinctly (sup pose tah) jocks pay dues to a union.
Or say, as other type union members, they pay union dues to union, not employer or government agencies.
And the jock colony is a majority of USA citizens/Hispanic.

The Equine Congress Reps and Senators as stakeholders will be more than glad to work with their constituents.
For good measure, there will be a lot of restraint of trade FTC legal suits, when these opposing groups cross swords.
Again. To date, HISA has pinned up on the corkboard about a dozen whip issues.
